      明清国家法律规定了里社制,随着里甲赋役制度的变革,里社制却逐渐废弛,被民间“社会”与民间信仰所取代。“社会”在长期的祭祀活动中,因为社会关联形成集体意识,这种共识可对超出村庄、宗族的公共事务发布禁约,从而产生地区公共秩序。国家法律与乡村秩序相互影响,在国家法律下行之时,乡村秩序则自生自发地生成回应型规则,认识和协调二者之关系,对于乡村治理有积极意义。
英文摘要:
      The national law of Ming and Qing Dynasties stipulated the Li-She system(里社制), but it gradually disappeared and was replaced by civil “society” and folk belief with the reform of Li-Jia system(里甲制). In the long-time sacrifice activities, “society” can form a collective consciousness because of social associations. This kind of consensus can issue a ban(禁约) on public affairs beyond the villages and clan, thus creating regional public order. The national law and the rural order influence each other, when the national law enters the country, the rural order spontaneously generates response rules, so understanding and coordinating the relationship between them has positive meanings for rural governance.
