      农村土地“三权分置”是将土地承包经营权分置为土地承包权和土地经营权,从而实现农村土地所有权、承包权和经营权“三权分置”,以促进土地经营权有序流转。土地承包经营权的身份属性,是土地承包权与土地经营权分置的理论基础。土地承包权,是指农户以集体经济组织成员身份为基础,以承包集体所有土地的同一地块为内容的综合性权利。土地承包权强调农户对集体所有土地的同一地块的权利,包括了持续承包、继续承包、优先购买和补偿请求等权利内容。
英文摘要:
      Three rights separation of rural land means rural land rights include land ownership, land contract right and land management right. In order to promote the orderly transfer of land management right, the land contract right and land management right are separated from land contract and management right. The theoretical basis of land contract right and land management right separation is identity attribute of land contract and management right. Land contract right represents a comprehensive right of farm household, based on the membership of collective economic organization, contracting the same plots of collective land. Land contract right focuses on farm household’s right to the same plots of collective land, and it includes durative contract right, consecutive contract right, preemptive right and claim of compensation.
