| 家庭农场是我国新型农业经营主体之一,家庭农场立法的缺失制约了家庭农场的培育和发展。家庭农场立法首先应当明确家庭农场的民事主体地位,这是家庭农场从事规模化、集约化、商品化农业生产,参与市场活动的前提条件。现有的民事主体制度不能适应家庭农场培育和发展的需求,应当明确家庭农场为新型的非法人组织。同时,界定家庭农场的民事主体地位,还应当明确以下三个问题：家庭农场与农户的关系,家庭农场成员和家庭成员的关系以及家庭农场的认定标准。 |

| Family farm is one of the new agricultural management entities in our country. The absence of family farm legislation is a disadvantage of fostering and developing family farm. First of all, the civil subject status of family farm should be clarified in the family farm legislation. The civil subject status of family farm is the prerequisite for family farm to engage in large-scale, intensive, commercial agricultural production and participate in marketing activities. The existing system of civil subject can’t accord with fostering and developing family farm, and family farm should be a new unincorporated organization. At the same time, in order to define civil subject status of family farm, the following three questions should be clarified, which are the relationship between family farm and farmer, the relationship between family farm member and family member, the identified standard of family farm. |
