| 在文献浩瀚的调解研究中，有关调解的百年历史嬗变研究还存在相对空白。文章基于法社会学视角，对1912～2012年间相关统计数据等进行再分析，从历史角度考察辛亥革命已降，调解在城乡民事纠纷的调处实践，分析其所嵌入的社会结构，总结其历史阶段特征与发展规律。研究发现，调解的百年嬗变历程为：中华民国时期的本原阶段，其表现为乡土礼俗调解；1949～1977年间的异化阶段，其表现为意识形态化调解；1978～2000年间的新生阶段，其表现为“情、理、法”调解；21世纪以来的重构阶段，其表现为“大调解”格局。调解的百年历史流变表明，由社会劳动分工所形塑的社会结构形式孕育了相应的法治模式与社会维系纽带，进而最终影响了调解的功能与特质。 |

| The research is relatively blank about the mediation research of hundred years’ history. Based on the view of Legal Sociology, this paper analyzed the official statistical data, the academic survey data, case, practical material, combining with the history study, investigated the mediation practice in solving civil disputes in the urban and rural areas after the Revolution of 1911, summarized the historical stage characteristics and the law of development. It was discovered that mediation had this evolution process of principle, heterization, rebirth, reconfiguration. And mediation forms were etiquette and custom mediation, ideology mediation, affection, science, law mediation and multipartite mediation. This century evolution process stated clearly that social structure plastic shaped by social labor division gave birth to the corresponding model of rule of law and social ties, and then affected the function and characteristics of mediation. |
