| 政府合法性既表现为公众对政府行为的尊重与认同,又表现为其行为未逾越一国现行法律
文本之规定。我国地方政府在农地征用过程中获取了不受财政预决算制度约束的巨额预算外资金,造
成诸多社会暴力、贪腐行为、挥霍浪费等恶性事件发生。基于制度经济学的分析视角,认为政府的土地
财政收益源于我国城乡差异性的土地制度安排,其实质是政府利用制度制定和执行优势,通过寻租行为
掠取了本属于农民的资源禀赋。通过考察现代政府合法性的演进缘由与历程,利用对比的方式,从法治
理念和法律文本层面对地方政府掠夺公众财富的行为予以有力批判。 |

| The legitimacy of government comport for its behavior gain the publics respect and identification, and is ex
pressed as its behavior isn't beyond the countrys current legal texts. In China, local governments get huge amounts of
funds from rural land acquisition, which didn't restricted by the fiscal budget and final account system, leading to much
malignant events such as social violence, corruption, waste and so forth. In China, local governments In the modern society of interests of differentiation, meaning competition and rules diverse, Publicity is impor
tant to integrate multiple hierarchical, enhance social mobilization, and reach social consensus. The formation and charac
teristics of publicity depend on not only the social structure, power structure in the village, but also the degree and mode of
intervention of state power. The disintegration of village publicity relate to the withdraw of state power. Through the longitudinal study of the traditional period, collectivization period, the individual period of three historical stages on village publicity upbringing and characteristics, we will better outline the relationship between village publicity growth and national authorities intervene. Perhaps this is instructive for us on how to balance and coordinate the degree and mode of intervention
of state power in the rural community in order to make the village publicity growth reasonable. |
