中文摘要:

政府合法性既表现为公众对政府行为的尊重与认同,又表现为其行为未逾越一国现行法律文本之规定。我国地方政府在农地征用过程中获取了不受财政预决算制度约束的巨额预算外资金,造成诸多社会暴力、贪腐行为、挥霍浪费等恶性事件发生。基于制度经济学的分析视角,认为政府的土地财政收益源于我国城乡差异性的土地制度安排,其实质是政府利用制度制定和执行优势,通过寻租行为掠取了本属于农民的资源禀赋。通过考察现代政府合法性的演进缘由与历程,利用对比的方式,从法治理念和法律文本层面对地方政府掠夺公众财富的行为予以有力批判。

英文摘要:

The legitimacy of government comport for its behavior gain the publics respect and identification, and is ex pressed as its behavior isn't beyond the countrys current legal texts. In China, local governments get huge amounts of funds from rural land acquisition, which didn't restricted by the fiscal budget and final account system, leading to much malignant events such as social violence, corruption, waste and so forth. Based on the The legitimacy of government comport for its behavior gain the public’s respect and identification, and is expressed as its behavior isn’t beyond the country’s current legal texts. In China, local governments get huge amounts of funds from rural land acquisition， which didn’t restricted by the fiscal budget and final account system, leading to much malignant events such as social violence, corruption, waste and so forth. Based on the analysis of institutional economics, hold the standpoint that the land finance of local government root from the differences land system arrangement between urban and rural areas in China, government used the advantage in the system of constitution and implementation, and plundered the resources endowment which belongs to the farmers through the rent-seeking behavior. Through review the evolution reason and course of the legitimacy of modern government, by the way of contrast, strongly criticize the local governments’ behavior of plundering the public’s wealth from the concept of law and legal texts.
