本文以湖北W村确权确地之后发生的土地纠纷为考察对象，发现祖业观、村落成员权和生存伦理权作为地权纠纷中的表达诉求，共同影响了土地产权的属性。细解这些地权纠纷中的表达逻辑，可以发现农民的地权观念深深扎根于传统的乡土社会中，同时社会主义的制度遗产作为一种路径依赖，在新的地权纠纷中也会发挥了重要作用。无疑，这些地方性的表达逻辑揭示了，产权不仅是“一束权利”，更是一种深深嵌入社会机理的地方性知识。这也提醒我们，唯有在地化地理解地权的分布样态，才能更深刻的认识中国的产权性质

英文摘要:

This paper analyzes the land dispute happened after land property clarification movement in W village, finding ancestral concept, and village member rights and surviving ethics rights, as requesting expression in land property dispute, jointly affect the attribute of land property. Break downing these expression logics in land property dispute, this paper extracts that the land property concept of peasant roots deeply in the countryside communities, and system heritage of socialism as one path dependence, is playing an important role in the new land property dispute. Absolutely, these localized expression logics reveal that property is not only “a bunch of rights”, but also a localized knowledge rooted in the social mechanism. This is reminding us, only comprehending the distribution status of property through localization view can insight into the attributes of Chinese land property.
