当前, 涉及农村私有房屋的案件越来越多, 但是针对农村私有房屋法律适用方面还存在的一些问题, 比如如何规范农村私有房屋买卖行为以及农村私有房屋能否设定抵押等, 造成法院在审理这些案件时感到步履维艰。而这些在新农村建设过程中常会遇到的现象又是法院在处理农村私有房屋案件时必须要考虑的问题, 因此如何顺利解决这些案件, 成为当代司法实践面临的一个挑战。

英文摘要:

Recently, more and more cases involving private houses in rural areas appeared and have caused many heated debates. However, problems like how to regulate the trading behavior existed in many sections in the application of law for private houses in rural areas and confused stakeholders. This entire phenomenon is frequently faced during the new countryside construction process and needed considered by court. Hence, how to successfully resolve these cases became a challenge to the contemporary judicial practice.
