| 中国法治建设进程中的一个突出问题是如何处理法律的现代性与地方性之间的关系。从地
方性的一面来看, 需要关注的是本土文化如何影响法律的运作。文章通过对江西省一个宗族村落中三
个纠纷案例的分析, 揭示在民间纠纷调解过程中, 存在对法律的差序利用, 即随着纠纷当事人血缘关系
的疏远, 运用法律的强度逐渐增强。这种情形反映了传统在当代中国农村的生命力。因此, 在法治建设
过程中, 应寻求包括传统价值在内的多种价值的相互融通。 |

| It is of great significance to handle the relationship between modernity and locality during the transition to a society
with the rule of law in China .How local cultures influence the use of law deserves our attention based on the perspectiv
e of locality .By analy zing three dispute cases in a village of Jiang xi province , this ar ticle sug gests that there is a pattern
of difference in the use of law during the dispute resolution , that is, the use o f law becomes more frequent and dense w hen
the kinship betw een the agents concerned gets mo re distant .The situation reflects the durability of the tradition in today'
s rural China .Fo r the reason above , we need to syncretize v arious kinds o f value including the traditional value during the
transition in law . |
