从一个村庄的生活世界之地志特征(topo graphic features)出发。基于民族志调查的材料, 文章表明:一方
面“ 村规民约” 支配着地方的林权制度模式, 另一方面也影响基层对国家政策规范的读解。在描述了这
些与历史和社会空间相联系的地方“ 法” 的生成以后, 文章提出研究必须以直面传统与现代性相互“ 共
度” 的主动思路来理解中国的社会变迁和国家治理, 以及建构社会理论。 |

| This paper discusses forestry tenure rig hts .How ever , the paper will not use the state law concerning proper ty
rights as a departure.On the co ntrary , from the life-wo rld of villag er s in relatio n to the topographic features of the villag
e, the paper , based on ethnographic data , shows that:o n the one hand “village post” has been reshaping the nature of
forestry tenure right despite of the imposition of state law/ policy , on the o ther hand the ag encies at the lev el of grass-roo ts
has mis-readed the national policies in or der to reach a so rt of “commensurability” between national laws and local norms.
Apart from accounting the misreading of law in a lo cal community and its linking the specific historical and social space ,
the paper concludes that it is time to turn to the approachs that will employ the “commensurability” between tradition and
modernity as a departure to co nstruct social theories of China and to understand the state governing and social changes happening
in China as w ell |
