中文摘要:

宪政与村民自治所具备的制度精神和制度原理一致, 它们有着几乎相同的价值追求, 有着近似一致的精神品格。中国的宪政建设不能忽视农村基层民主宪政, 没有农村基层民主宪政化, 就不会有整个国家的民主宪政化, 村民自治自身具有丰富的法律内涵和宪政精神。中国村民自治的研究应当突破传统思维视角和研究进路, 从宪政的角度对村民自治问题进行分析和阐释, 揭示村民自治的宪政价值。

英文摘要:

Constitutionalism has the same system spirit and institutional principle with villagers' self-gover nment .Bo th of them almo st have the same value pursuit and spiritual character .Furthermore , the Chinese constitutional g overnment co nstruction can not ignore its w ork in the rural basic level w hich can realize the democratic co nstitutionalism throughout China and provide abundant legal conno tatio n and constitutional spirit to the villagers' self-government .The Research on Villagers' Self-government of China should break the traditional thinking perspective and research route , meanwhile , analy ze and interpret the relev ant problems of villagers' self-government with the purpose of revealing its real value .
