| 文章从法社会学的理论视角, 对豫南一个村庄中的丧葬改革进行了实证研究, 具体分析了殡
葬法规的实际运行及其效果。文章指出, 在丧葬实践中人们并没有按照国家的法规操办丧事, 殡葬改革
并没有达到预期的效果。国家法规从颁布实施到真正对社会生活发生影响, 中间存在着“ 时间差” 。同
时, 法规在实际的运行中也会受到基层政权的操作以及原有行为规则的影响, 正是这些因素影响了法规
的运行效果。 |

| The paper is an experiential study on funeral rite reformation from the view of sociology of law with the aim to
analyze the effect and process of Regulation on Funeral .The material comes from a village in the south of Henan province .
This article points out that people do not follow the state funeral regulation and the government does no t achieve the purpo
se of the funeral regulation .A law really takes effect long after it is enacted.Moreover the effect of the law is g reatly
impacted by the local authority and the former regulation . |
