| “ 三农问题” 首先是一个政治问题, 从法治社会角度而言“ 三农问题” 同时也是一个法律问题, 而且是一
个社会法问题。社会法是国家为解决各种社会问题而制定的具公、私法相融合特点的第三法域。私法仅就农民利
益问题寻求救济, 而国家行为对市民社会亦难以作为, 故“ 三农问题” 由于牵涉到社会整体利益, 应归于第三法域
——— 社会法调整范畴, 文章以社会法视角, 从降低农业人口、农村城市化和农民教育三方面, 审视我国当前“ 三农问
题” 。 |

| Issues o f ag riculture , farmer and rural are political issues, and legal issues also from the point o f legal view , further more it
is issues of the social law .The so cial law is the third field of law w hich is instituted by government for solving the social problems.
Neither the private law no r the public law can solve the problems combined with agriculture , farmer and rural, so only the social law
to reso lve them from reducing the population of farmers, moder nizing the rural areas , educating farmer s and etc . |
