| 土地承包经营权是建立在集体所有权之下的一种新型用益物权, 其长期性和稳定性对于保持农村社会
稳定、保证农业持续发展具有十分重要的意义。《农村土地承包法》赋予了农民长期而有保障的土地承包经营权,
在权利的稳定性和权利的维护方面有了很大的突破, 有利于进一步调动农民的积极性。但是, 该法对土地承包经
营权的性质界定及在妇女承包权益维护上仍存在着一定的缺陷。 |
