| 期货交易所是期货市场运营的核心,其功能决定了期货交易所的法律性质应是公益
性、非营利性的法人。此类法人是市场经济条件下产生的新型法人—— 会员制法人。期货交易所的
设立制度与组织形式的选择因各国的国情不同而各异。我国已成为W TO的成员,应在借鉴西方先
进的期货交易所法律制度基础上,把我国的期货交易所改造成为实质意义上的会员制交易所。 |
