| 农民问题是中国现代化进程中的一大难题。农民权利问题一方面是由于新中国建国后
政府的经济体制和政策造成的城乡不平等问题,另一方面是由于法律制度的不完善形成的农民自
身权利受侵犯的问题。针对此现状,笔者通过对实然与应然的分析,主张以国家和社会的良性互动
为理论基础,来建构保护农民权利的法律机制。 |

| Issues r eg arding farmers in China ar e o ne of the hardest pro blems in China 's mo der nizatio n process.
The issue o f fa rmer 's rig hts is, o n o ne hand, the urba n-rural inequality r esulted f rom the eco nomic system and
gov ernment 's policies after the founding of New China, and on the o th er ha nd, violatio n on farmer s ' rights due
to the inadequate legal sy stem. In the ligh t of this reality and making “ being” and “ ought-to-be” analy sis, the
autho r maintains tha t a legal system, ba sed on the positive interactio n betw een the gov ernment and the society ,
should be esta blished to pro tect rights of the fa rmer. |
